[Remote] Counsel, Marketing and Advertising

The Marketing and Advertising Counsel will provide legal guidance on advertising and promotional materials to ensure compliance with relevant regulations while supporting business growth and customer experience.ResponsibilitiesServe as a legal subject matter resource on advertising, promotion, and marketing compliance matters related to healthcare, telehealth, pharmacy, wellness, and FDA-regulated products/servicesPartner closely with Marketing, Growth, Product, Clinical, and Compliance teams to review and advise on consumer-facing materials across multiple channels, including:Paid media (Google, Meta, TikTok, etc.)Website and landing pagesSocial media contentEmail/SMS campaignsPodcasts and video contentTV/radio spotsInfluencer and affiliate marketingPromotional campaigns, contests, and sweepstakesParticipate in and support a collaborative legal/compliance/marketing review process that enables scalable and compliant campaign executionProvide practical, business-oriented legal guidance balancing regulatory requirements with growth and speed-to-market objectivesHelp develop and maintain marketing and advertising compliance playbooks, templates, and guidance materials for internal teamsMonitor and advise on changes in FTC, FDA, telehealth, privacy, and healthcare advertising regulations, enforcement actions, and industry trendsConduct trainings and provide ongoing guidance to internal stakeholders on marketing compliance best practicesIdentify potential regulatory or reputational risks in campaigns and partner cross-functionally to develop solutionsSupport strategic initiatives involving new healthcare offerings, products, and partnerships from a marketing and advertising compliance perspectiveOther duties as assignedSkillsJuris Doctor (JD) from an accredited law school and active membership in good standing with at least one U.S. state bar4–7+ years of experience practicing FDA, FTC, healthcare regulatory, advertising, or promotional law, preferably within healthcare, digital health, telehealth, pharmacy, wellness, or consumer health industriesStrong knowledge of FTC advertising regulations, FDA promotional guidance, and healthcare marketing compliance requirementsExperience advising on consumer-facing healthcare or regulated-product marketing across digital and traditional media channelsStrong business judgment with the ability to provide practical, solutions-oriented guidance in fast-moving environmentsExcellent communication and stakeholder management skills with the ability to collaborate effectively across legal, marketing, product, compliance, and executive teamsHighly organized and detail-oriented, with the ability to manage multiple projects and deadlines simultaneouslyComfortable operating independently in a rapidly scaling organizationExperience building scalable review processes, templates, or operational guidance preferredBenefitsMedical, Dental, and Vision plansFlexible Spending/Health Savings AccountsFlexible PTO401(k) + Company MatchLife Insurance, Pet insurance, and moreCompany OverviewOpenLoop is the nation’s top white-label digital health infrastructure provider, powering virtual care delivery for healthcare organizations, employers, retailers, and consumer brands.
